There are crimes that are defined differently when women commit them than when men do.  The crime of shoplifting, for example, is an old one, but at the end of the 19th century it suddenly became associated with women and the new department stores.  Even here, outcomes depended on social class; men and lower class women were routinely prosecuted for theft; "respectable" women were very frequently described as ill with the "disease" kleptomania and quietly remanded to their families.
